Terms of Service

These Terms of Service ("Terms") govern your access to and use of the EZ70B service ("EZ70B," "the Service") provided by Phase Tech LLC ("Phase Tech," "we," "us," "our"), a Kentucky limited liability company headquartered in Hopkinsville, Kentucky.
1. Acceptance
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Subscription, billing, and renewal
EZ70B is offered as a subscription on monthly or annual billing cycles. Self-serve tiers (Standard and Advanced) are billed in advance through our payment processor. All paid subscriptions auto-renew at the end of each term unless cancelled before the renewal date. You may cancel at any time from the in-app billing settings; cancellation takes effect at the end of the current billing period and you retain access until then.
A 14-day trial is offered on Standard and Advanced. A valid payment method is required to start the trial; you will not be charged before the trial ends if you cancel in time.
Enterprise and Total (Partner) tiers are sales-led and governed by a separate written order form.
3. Your data, your records
You own the data you put into EZ70B — your asset records, photos, attachments, work orders, and account metadata. We process that data on your behalf to provide the Service. We do not sell your data. Sub-processors used to operate the Service (Stripe, Resend, Supabase, Sentry) are listed in our Privacy Policy.
You may export your data at any time via the in-app export tools or by contacting support. Upon termination, we will retain your data for 30 days to allow you to export it, then delete it.
4. Acceptable use
You agree to use the Service in compliance with our Acceptable Use Policy. Violations may result in suspension or termination of your account.
5. Electrical-data disclaimer
EZ70B is a record-keeping and workflow tool. It is not a substitute for licensed electrical inspection, professional engineering judgement, or compliance certification by an Authority Having Jurisdiction (AHJ). The Service does not guarantee NFPA compliance; compliance is your responsibility and must be verified by qualified personnel. Diagrams, schedules, and reports generated by the Service are aids, not certifications, unless explicitly signed by a licensed Professional Engineer (PE) under our Total (Partner) plan.
6. Limitation of liability
To the maximum extent permitted by law, Phase Tech is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising out of or in connection with the Service. Our aggregate liability for any direct damages is limited to the amount you paid us in the twelve months preceding the claim.
7. Indemnification
You agree to indemnify and hold harmless Phase Tech LLC from claims arising out of your use of the Service, your data, or your violation of these Terms.
8. Governing law
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Jefferson County, Kentucky.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect.
